Effective date: August, 2025

SRNY Film (“SRNY Film,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit srnyfilm.com, contact us, or use our photography, videography, and content‑production services in the Vancouver, BC area and elsewhere.

Important: This Policy is designed to comply with the BC Personal Information Protection Act (PIPA) and Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA). Where applicable, it also summarizes rights available under other laws (e.g., GDPR, CPRA). This Policy is not legal advice.

1) Who we are & scope

This Policy applies to personal information we handle as a private sector service provider (e.g., clients, prospects, website visitors, event participants). It does not apply to the personal information of our employees or contractors, which is handled under separate notices.

2) What we collect

We collect the following categories of personal information:

A) You provide directly

  • Contact details (name, email, phone, social handle, company)
  • Project details (location, dates, content brief, brand preferences)
  • Payment‑related information (e.g., invoice details; payments may be processed by third‑party providers who collect card data directly)
  • Consent forms / appearance releases (e.g., model releases, location permits)
  • Communications (emails, DMs, forms, testimonials)

B) Collected automatically (online)

  • Device and browsing data (IP address, cookies, approximate location, pages viewed, links clicked, session duration)
  • Basic analytics data for site performance and audience insights

C) From third parties

  • Social networks and advertising platforms (e.g., if you engage with us on Instagram)
  • Referrers, partners, and publicly available sources (e.g., business directories)

We do not seek to collect sensitive health data, precise geolocation, or information about minors without parental/guardian consent. Please do not submit personal information that is not relevant to your project.

3) Why we collect it (purposes)

We use personal information to:

  1. Provide and manage our services (pre‑production, filming, editing, post‑delivery)
  2. Communicate with you (quotes, scheduling, approvals, support)
  3. Personalize content (creative direction, covers, deliverable formats)
  4. Process payments and accounting
  5. Operate and secure our website and systems (fraud prevention, diagnostics)
  6. Conduct analytics and improve services
  7. Market our services (with your consent where required by CASL)
  8. Meet legal, tax, and regulatory obligations

4) Our legal bases / consent

Under PIPA and PIPEDA, we generally rely on your consent (express or implied) to collect, use, and disclose personal information. In some cases we may rely on other lawful grounds (e.g., contractual necessity, legal obligations, or legitimate interests such as ensuring network security and preventing fraud). You may withdraw consent at any time, subject to legal or contractual restrictions and reasonable notice.

5) Marketing communications (CASL)

We follow Canada’s Anti‑Spam Legislation (CASL). We send commercial electronic messages (emails, texts, DMs) only with consent (express or implied). Every message includes an unsubscribe method. You can also email info@srnyfilm.com with the subject line “Unsubscribe”.

6) Cookies & tracking

We use cookies and similar technologies to operate the site and understand traffic. You can manage cookies through your browser settings. Blocking some cookies may affect site functionality.

Types of cookies we may use

  • Essential: Required for core features (security, forms)
  • Performance/Analytics: Help us measure visits and improve the site
  • Preference: Remember choices (language, layout)
  • Advertising/Measurement: If enabled, help us measure ad performance and audiences

We do not respond to Do Not Track (DNT) signals at this time due to lack of industry standardization.

7) Analytics & ads

We may use analytics tools (e.g., Google Analytics) and advertising platforms (e.g., Meta). These providers may set cookies or collect data directly. They act as our service providers or independent controllers, depending on the tool. You can opt out of interest‑based advertising via your platform settings and the AdChoices program where available.

8) Photography & videography specifics

Because we produce media content, we may collect and process:

  • Appearance information (your image/likeness/voice) if you are filmed or photographed
  • Event context (venue, date/time, participants)
  • Releases and permissions (model releases, location permits)

Participation & consent

  • We obtain consent from clients and featured participants where appropriate. Clients are responsible for ensuring they have the authority to include participants (e.g., employees, contractors, guests) and for providing any required notices.
  • For minors, a parent/guardian must provide consent.

Public or incidental capture

  • In public spaces or events, bystanders may be incidentally captured. We aim to frame respectfully and honor reasonable requests to avoid/blur where feasible.

Usage

  • Deliverables are used per your agreement/license. With your permission, we may showcase samples in our portfolio, website, or social media.

9) Real estate & on‑location filming

When filming at private properties, the client represents they have the necessary permissions from owners/occupants. Upon reasonable request, we will evaluate blurring or cropping identifying details (e.g., license plates, unit numbers) where technically feasible, without compromising the deliverable.

10) How we share information

We share personal information only as needed and consistent with this Policy:

  • Service providers (hosting, cloud storage, analytics, email, project management, payment processors)
  • Professional advisors (accountants, legal counsel)
  • Business transfers (e.g., if we sell or restructure our business)
  • Legal compliance (to comply with laws, enforce agreements, or protect rights and safety)

We do not sell personal information.

11) International transfers

Our service providers may store or process personal information outside Canada (e.g., the U.S. or EU). When information is transferred internationally, it may be subject to foreign laws and lawful access by courts, law enforcement, or regulatory authorities in those jurisdictions.

12) Retention

We keep personal information only as long as needed to fulfill the purposes above, and to meet legal, accounting, or reporting requirements. Typical retention periods:

  • Project files and releases: up to 7 years after final delivery (or as required by law/contract)
  • Accounting/transaction records: 7 years
  • Marketing lists: until you unsubscribe or we no longer need the data
  • Web analytics data: as configured by the analytics provider

When information is no longer needed, we securely delete or anonymize it.

13) Security

We implement reasonable administrative, technical, and physical safeguards appropriate to the sensitivity of the information (access controls, encryption in transit where supported, least‑privilege practices). No method of transmission or storage is 100% secure. If we detect a breach that creates a real risk of significant harm, we will notify affected individuals and/or regulators as required by law.

14) Your rights (Canada)

Subject to limited exceptions under PIPA/PIPEDA, you have the right to:

  • Access your personal information in our custody or control

We may request additional information to verify your identity. We aim to respond within 30 days (or provide a reason for any extension permitted by law). Reasonable fees may apply for copies or retrieval as allowed by law.

Complaints

If you are not satisfied, you may contact the Office of the Information and Privacy Commissioner for British Columbia (OIPC) or the Office of the Privacy Commissioner of Canada (OPC).

15) Additional regional rights (if applicable)

If you are located in the EU/UK, you may have additional rights under GDPR/UK GDPR (e.g., data portability, restriction, objection, and the right to lodge a complaint with your local Data Protection Authority). Our primary legal bases are consent, contract, legitimate interests, and legal obligations.

If you are a resident of certain U.S. states (e.g., California), you may have rights to know/access, delete, correct, and opt out of certain data sharing. We do not sell personal information. We also do not engage in profiling in furtherance of decisions that produce legal or similarly significant effects.

16) Children’s privacy

Our services and website are not directed to children under 13. We do not knowingly collect personal information from children without verifiable parental consent. If you believe a child has provided personal information to us, please contact us to request deletion.

17) Third‑party links & platforms

Our website and deliverables may include links to third‑party sites or platforms (e.g., Instagram, YouTube). Those sites have their own privacy practices. We are not responsible for their content or policies.
