Terms & Conditions

These Terms & Conditions (the “Terms”) govern your access to and use of srnyfilm.com (the “Site”) and any photography, videography, and content‑production services provided by SRNY Film (collectively, the “Services”). By visiting the Site, requesting a quote, booking, paying a deposit, or accepting a proposal, you agree to be bound by these Terms.
Note: These Terms are tailored for a photography/videography studio operating in British Columbia, Canada. They are not legal advice.
1) Who we are

2) Definitions
- Client/You: The person or entity purchasing Services.
- Deliverables: The final edited photos/videos, reels, covers, or other materials we deliver.
- Booking: A confirmed Service date/time after acceptance of a quote/proposal and receipt of any required deposit.
- Order/Proposal/SOW: The written quote, proposal, or statement of work describing your project.
- Shoot Day: Any day scheduled for production/filming/photography.
3) Scope & order of precedence
If there is any conflict between these Terms and a signed Order/Proposal/SOW or Master Services Agreement (MSA), the signed document prevails for that project. Any rider (e.g., NDA, location agreement) agreed by both parties also forms part of the contract.
4) Quotes, bookings & payments
- Quotes/Estimates. Prices are given in CAD and are exclusive of taxes unless stated otherwise.
- Deposit. A 25% non‑refundable deposit is required to secure a Booking unless we state otherwise in writing.
- Balance. Unless specified in the Order, the remaining balance is due on delivery of draft or final Deliverables. Delivery may be withheld until payment is received.
- Overtime/Waiting. Overtime, significant waiting time, extra locations, or scope changes are billed at our then‑current rates and will be quoted/approved where feasible.
- Expenses. Reasonable out‑of‑pocket costs (e.g., permits, parking, travel outside standard zones, rentals) are billable with receipts.
- Late payments. Overdue amounts may accrue interest at the lesser of 2% per month or the maximum allowed by law.
5) Rescheduling, cancellations & no‑shows
- Rescheduling. With at least 48 hours’ notice, we will reschedule once at no extra charge, subject to availability. Further changes may incur a fee.
- Cancellations. Client cancellations forfeit the deposit. If cancellation occurs within 24 hours of a Shoot Day or after crew/resources have been reserved, additional fees may apply for costs we cannot recover.
- Weather/Force majeure. For outdoor shoots or drone work, we may postpone for safety or unsuitable conditions. We will coordinate the earliest practical alternative.
6) Client responsibilities
- Permissions & access. You are responsible for access to locations, parking, schedules, and obtaining necessary permissions from owners/occupants/venues.
- Participants. You represent that you have authority to include participants (e.g., employees, guests) and will provide any required notices. Parental/guardian consent is required for minors.
- Brand assets. You warrant that any materials you supply (logos, music, scripts, images) are properly licensed, and you grant us the rights needed to use them in the project.
- Safety. You agree to maintain a safe working environment and follow reasonable directions relating to safety and crowd control.
7) Production rules (including drone & venue policies)
- Drones. Any aerial work will comply with Transport Canada rules and local bylaws. No‑fly zones, weather, or permits may limit or prevent drone use, even if previously planned.
- Venue/Property rules. We must follow venue restrictions (lighting, rigging, sound, insurance). Additional permits or insurance certificates can be arranged at Client cost.
- Coverage. We will exercise professional judgment to capture key moments; however, we cannot guarantee the recording of every specific shot or moment due to logistics, venue rules, or unforeseeable conditions.
8) Deliverables, revisions & approval
- Formats. Deliverables are provided as digital files in standard formats suitable for the intended platform(s) (e.g., 4K masters and social exports).
- Turnaround. Typical delivery is 3–7 business days after filming, depending on scope/volume. Rush options may be available at additional cost.
- Revisions. Unless stated in the Order, Deliverables include one (1) standard revision round for edits that do not require re‑shooting. Additional revisions are available at our posted add‑on rate.
- Approval window. If you do not provide consolidated feedback within 7 days of delivery of a draft, we may treat the Deliverable as accepted for invoicing and scheduling purposes.
- Archiving. We take reasonable care of project files but do not guarantee indefinite storage. Long‑term archiving may be offered as a paid add‑on. See our Privacy Policy for retention practices.
9) Intellectual property & licensing
- Ownership of raw footage. Unless otherwise stated in writing, we retain all rights in raw footage and project files.
- License to Client. Upon full payment, you receive a non‑exclusive, non‑transferable license to use the final Deliverables for your brand’s own social media, website, and internal presentations. Printing, broadcast, paid advertising, resale, sublicensing, templates, or use by affiliates/franchisees/partners are not included unless expressly licensed in the Order.
- Third‑party materials. Where Deliverables include third‑party assets (music, fonts, stock), your use is subject to those suppliers’ license terms. Some uses (e.g., broadcast, large‑scale paid ads) may require additional licenses/fees.
- Credit/Watermark. We may include a discreet credit if agreed. You may not remove any embedded copyright metadata.
10) Portfolio usage & publicity
We love to showcase our work. Unless you opt out in writing before the shoot or we sign an NDA, you grant us permission to display Deliverables (and your trademarks as incorporated therein) on our Site, socials, and reels for portfolio and marketing purposes.
11) Real estate shoots & on‑location filming
- Accuracy & staging. Visuals are for marketing and illustrative purposes only; measurements, colors, and features may vary. We do not provide engineering, appraisal, or building‑inspection services.
- Privacy. Upon reasonable request, we can evaluate blurring/cropping of sensitive details (e.g., license plates, unit numbers) where technically feasible without compromising quality.
12) Website terms of use
- Acceptable use. Do not misuse the Site (e.g., introduce malware, scrape content, attempt unauthorized access).
- Content & IP. All Site content (text, images, logos) is owned by SRNY Film or our licensors and protected by IP laws. You may not copy, redistribute, or create derivative works without permission.
- Third‑party links. Links on the Site may lead to external sites; we are not responsible for their content or policies.
13) Privacy
Your use of the Site and our handling of personal information are governed by our Privacy Policy (see the separate page). By using the Services, you consent to the collection and use of information as described there.
14) Warranties & disclaimers
- We warrant that we will perform the Services with reasonable skill and care consistent with industry standards.
- Except as expressly stated, the Services and Site are provided “as is” without warranties of merchantability, fitness for a particular purpose, or non‑infringement.
- We are not responsible for platform decisions (e.g., social‑media algorithms, takedowns, or muting due to third‑party rights claims) beyond our reasonable control.
15) Limitation of liability
To the maximum extent permitted by law:
- Our aggregate liability for any claim arising out of or relating to the Services is limited to the fees actually paid by you for the specific project giving rise to the claim.
- We are not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages (including loss of profits, revenue, goodwill, or data), even if advised of the possibility of such damages.
16) Indemnification
You agree to defend, indemnify, and hold harmless SRNY Film and our personnel from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your breach of these Terms; (b) your supplied materials; (c) your failure to obtain necessary permissions or releases; or (d) your misuse of the Deliverables.
17) Confidentiality & NDAs
Each party may use the other’s confidential information solely for the project and must protect it using reasonable safeguards. We are happy to sign a mutual NDA upon request; NDA terms will prevail over public portfolio rights as specified.
18) Subcontractors & independent contractor status
We may engage vetted subcontractors (e.g., second shooters, drone pilots) to assist. We operate as an independent contractor, not your employee or agent.
19) Force majeure
Neither party is liable for delays or failures due to causes beyond reasonable control (e.g., extreme weather, illness, strikes, government restrictions, utility failures, epidemics). If a Force Majeure event occurs, schedules will be adjusted in good faith.
20) Governing law & dispute resolution
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein.
Dispute process: (1) good‑faith negotiation; (2) mediation in Vancouver, BC; and if unresolved, (3) either party may pursue legal remedies in the courts of British Columbia. Each party bears its own costs unless a court orders otherwise.
21) Changes to Terms
We may update these Terms from time to time. The “Effective date” above reflects the latest version. Material changes will be posted on this page.

23) Acceptance
By booking, paying a deposit, or replying “AGREED” to a proposal or email, you confirm that you have read, understood, and agree to these Terms.
